Driver Discipline and Disqualification The School District requires that all vehicles performing District transportation service will be operated in a safe and defensive manner so as to reflect a positive image of the School District and the employing contractor. Drivers violating the provisions of these Specifications, or District operational and safety guidelines, including those making unauthorized stops, speeding, misusing the eight light system, committing repeated moving violations, or engaged in other unsafe or illegal activities shall be subject to removal from service for the District.
Independent School District No. 625 monitors the compliance of school bus drivers operating under contract to the School District with Minnesota Statutes, State Agency Rules, District Board Policies, District Operational Guidelines, and the conditions of these Specifications through the use of route observation, traffic radar and laser equipment, mobile video equipment, and ride-a-long observation.
Drivers violating District operational and safety guidelines shall be subject to suspension or removal from service for the District. Violations include, but are not limited to:
1. Speeding. 2. Traveling too fast for road conditions, traffic conditions, or residential areas. 3. Failing to legally stop for traffic signals or stop signs. 4. Operating the school bus in a careless or reckless manner. 5. Driving in a unsafe or aggressive manner. 6. Traveling the wrong way on one-way roadways. 7. Failing to legally signal turns or lane changes. 8. Traveling at an unsafe speed in a school-loading zone. 9. One or more chargeable accidents on District service. 10. Two or more preventable accidents on District service. 11. Actions related to responsibilities as a school bus driver under this contract which are deemed by the Transportation Administrator or Transportation Safety Director to be negligent. 12. Backing up in a prohibited school-loading zone. 13. Using the eight light system in an improper or illegal manner. 14. Failure to follow the lawful direction of a police officer. 15. 16. Making unauthorized stops. 17. Committing repeated moving violations. 18. Engaged in other unsafe or illegal activities. 19. Failure to report as directed in court as a witness in a stop arm violation trial. 20. Allegations of assault against a student not resulting in a criminal charge. 21. Willful use of indecent or profane language at, or within hearing distance of, students or staff. 22. Use of obscene or offensive gestures toward students, staff, public, or other drivers. 23. Other moving violations of Section 169, Minnesota Statutes. 24. Use of a radar detector as prohibited under Federal Motor Carrier Safety Regulations. and as outlined in section III-F-206 of these Specifications. 25. Insubordination, as defined in section III-F-218 of these Specifications. 26. Failure to follow the instructions of the School District. 27. Defiance of directives form the School District 28. Unauthorized deviation from the assigned route as issued by the School District. 29. Use of the public address system in an abusive manner toward students or public. 30. Willful submission of false Incident Report Forms on District students. 31. Inappropriate use of the brakes, swerving, or other use of the school bus as a discipline tool. 32. A serious or repeated moving violation by a school bus driver other than as outlined above. 33. Any sexually inappropriate actions, or suggestions, toward staff, students, parents, public, or other drivers. 34. Any racially inappropriate actions or statements toward staff, students, parents, public, or other drivers. 35. Disparaging or derogatory comments toward students, staff, parents, public, or other drivers. 36. Violation of the District policy on smoking and use of tobacco products. 37. Inappropriate and/or unacceptable conduct while on District property. 38. Deceitfully obtaining information restricted under federal or state data privacy laws and rules. 39. Failure to maintain the confidentiality of personal information for both regular and special education students transported by the driver. 40. Failure of the driver to turn on the two-way radio and to monitor the radio whenever transporting District students or staff on routes or field and athletic trips. 41. Failure of the driver to immediately report a collision, personal injury accident, or safety related passenger incident. 42. Failure to immediately report a citation for a moving violation to the employer. 43. Use of audio headphones while operating a school bus under this contract. 44. Use of a cellular telephone while operating a school bus under this contract. 45. Frequently missing or deliberately skipping designated student pick-up point(s). 46. Repeated failure of the driver to properly display his/her District identification card, on their outer garment, when entering and conducting business within a school or other District facility. 47. Use of a District driver identification card to enter a District facility, or be present on District property, for other than official business on behalf of the employer. 48. Refusal of a driver to transport a particular student without notification of student suspension from the school principal, Transportation Department, Transportation Department police officer, or employing contractor. 49. Falsification of reports to the District or other agency filed at the request of the District. 50. A physical confrontation with a parent, school bus driver, school staff person, or student which in the opinion of the District was an avoidable incident. 51. Disorderly conduct in a School District facility. 52. The threat of violence toward any individual. 53. Any conduct which creates a threatening or intimidating environment for staff or students. 54. Attempts to physically or verbally intimidate students, staff, parents, public, or other drivers. 55. Initiation of a confrontation with another school bus driver. 56. Distribution of unauthorized materials to students or staff. 57. Two of more observations by District safety staff or police in which the driver fails to check the school bus at the end of each run for sleeping children as required by these Specifications.

Certain very serious infractions will result in automatic removal of a school bus driver from further District Service. These infractions include, but are not limited to, the following actions by the school bus driver:
1. Use of alcohol, or a controlled substance while operating a school bus. 2. Under the influence of alcohol, or a controlled substance, while driving a school bus. 3. Refusal to submit to a post accident or probable cause incident test for alcohol or drugs. 4. Conviction for vehicular homicide while operating any vehicle. 5. Conviction of any crime involving assault using a motor vehicle as a weapon. 6. Conviction of careless or reckless driving in a Commercial Motor Vehicle. 7. A serious CDL violation while operating a school bus. 8. A citation by the Saint Paul Police Department for 10 or more miles over the posted limit. 9. A radar or laser observation by the District safety staff for 10 or more miles over the posted limit. 10. Three or more documented incidents of speeding under 10 miles per hour over the posted limit. 11. A hit and run accident by a school bus driver while performing District service. 12. Conviction of a stop arm violation by a school bus driver while operating a school bus. 13. Driving carelessly or recklessly. 14. Allowing a student, or other unauthorized person, to operate (drive) the school bus. 15. Allowing a student to operate any mechanical or safety system on the school bus such as steering, shifting, or eight light system. This does not preclude operation of the two-way radio, fire extinguisher, first aid kit, emergency exits, or other safety equipment in an emergency situation while assisting the driver, or while the driver is incapacitated. 16. Failure to check the school bus for sleeping students resulting in a student being left unattended on the bus. 17. Leaving a bus unattended or unsecured with students on board. 18. Possession of a handgun, knife, BB gun, replica firearm, or other weapon by a bus driver. 19. Threatening or implying the use of any weapon, or object which could be used as a weapon. 20. Possession of a chemical irritating spray such as Mace, Pepper Mace, P+P, CURB, or other chemical spray containing Alphachloracetopheone (CN), CS, Oleoresin Capsicum, pepper juice, or other chemical irritant. 21. Willful reporting of false or misleading stop arm violations. 22. Ejecting a student from a school bus at anytime enroute, or at school in the afternoon. 23. Conviction of assault against a student. 24. Falsification of driving or employment record for employment application purposes. 25. Inappropriate interaction or contact with students outside of working hours. 26. Contact with a student outside of working hours without the approval of the parent or guardian. 27. Encouraging or allowing students to push a stuck school bus. 28. Transportation of a student to or from school in a driver's personal vehicle as outlined in section III-F-226 of these Specifications. 29. Violation of the District Policy on smoking and use of tobacco products following a verbal or written warning or notification to contractor. 30. Inappropriate and/or unacceptable conduct while on District property. 31. Provision of alcohol or tobacco products to a student. 32. Provision of drugs, either controlled or uncontrolled, or of bogus drugs, to a student. 33. Possession, use, or sale of any controlled substance while on duty under this contract. 34. Possession of drug paraphernalia while operating under this contract. 35. Possession, use, or sale of any intoxicating beverage while on duty under this contract. 36. Possession of a bogus drug or drug paraphernalia. 37. False representation to students, staff, or the public that the driver is a Police Officer, School District official, or contractor supervisory employee. 38. Theft of School District property. 39. Refusal of a driver to produce a District identification card when requested by a Transportation Department Supervisor, building principal, or District Security Administrator. 40. 41. Sale of fireworks or other explosive devices to a student. 42. Extortion of a student or family of a student 43. Participation while on District contract service in any activity that advertises or promotes gang activity. 44. Failure to Yield to an emergency vehicle displaying red lights and siren 45. Use of the school bus in a aggressive or deliberately unsafe manner toward another motorist.
In the event that flagrant or repeated violations are detected, the District may:
1. Direct disciplinary action against the offending driver(s) including suspension or removal of the driver(s) from District service. 2. Require an appearance before the District Accident/Incident Review Committee. 3. Refer its findings to the Saint Paul Police Department, the Minnesota State Highway Patrol, or the Driver License Division of the Minnesota Department of Public Safety with a request for specific enforcement activity.
In the event of repeated serious offenses, the District will request the assistance of the Minnesota State Patrol, Saint Paul Police Department, or other appropriate agencies in correcting unsafe or illegal driving habits. The District Transportation Department will report to the Chief Driver License Evaluator, Minnesota Department of Public Safety, the name, license number, and other identification information of drivers committing repeated traffic violations, or serious offenses, with the recommendation that the Department revoke the school bus endorsement of the driver.
