Moving Violations
198. Drivers with Multiple Moving Violations The District expects that all drivers employed on District contract routes will have a good driving record in both private and commercial vehicles. The District periodically will review the records of each driver employed under this contract and may preclude assignment of any drivers with serious, or repeated, moving violations in either private or commercial motor vehicles.

199. Drivers with Serious Non-CDL Moving Violations The District will review cases where drivers have serious moving violations that do not involve commercial vehicles, including careless or reckless driving, on an individual basis. Offenses covered under Minnesota Department of Public Safety Rules Section 7414.0400 and/or Minnesota statute 171.3215, including Driving Under the Influence, will be covered as outlined under item III-F-159 and III-F-164 of these Specifications.

200. Speed Each school bus driver is expected to operate his/her school bus in strict accordance with the posted speed limit. Drivers are expected to adjust their speed to allow for the current traffic, road, and weather conditions.

201. Incidents of Excessive Speed Any driver who is cited by the Saint Paul Police Department, State Patrol, or other law enforcement agency, or who is monitored by District Transportation Safety staff driving at excessive speed while transporting District students shall be subject to the following disciplinary actions:

Under 6 miles per hour over the posted speed limit:
Observation Report to the employing contractor with further action based upon circumstances of the incident and the history of the driver in the school district.

Six to nine miles per hour over the posted speed limit:
Driver Incident Review Panel or meeting with District safety staff and possible exclusion from all further service to the school district with the decision to be based upon the driver's attitude, the circumstances of the incident, and the history of the driver in the school district.

Ten or more miles per hour over the posted speed limit:
Exclusion of the driver from further service in the school district.

The District Transportation Administrator, or Transportation Safety Coordinator, may impose a fine of up to five hundred dollars ($500.00) for each instance in which a school bus which is transporting District students or staff is monitored at ten (10) or more miles per hour over the posted speed limit. The application of the penalty, and the amount of the penalty, shall be at the sole discretion of the District Transportation Administrator or Transportation Safety Coordinator.

In executing this contract the contractor agrees to take disciplinary action, including written warning, suspension, and termination of employment, against all contractor drivers who are identified as speeding in Saint Paul whether or not they were performing District service at the time of the incident.

202. School Bus Stop Arm Violation No driver shall operate a school bus under this contract who has:

1. A misdemeanor conviction for a violation of MS 169.444 Subd. 2 in a private vehicle within the previous year.
2. A gross misdemeanor conviction of MS 169.444 Subd. 2 in a private vehicle within the previous three years.
3. A misdemeanor conviction for a violation of MS 169.444 Subd. 2 in a school bus within the previous three years.
4. A gross misdemeanor conviction for a violation of MS 169.444 Subd. 2 in a school bus within the previous five years.
5. A misdemeanor conviction for a violation of MS 169.443 within the previous five years.

203. Operating a School Bus After Suspension or Revocation Any driver who operates a school bus under this contract after notification by the Minnesota Department of Public Safety that his/her school bus endorsement has been suspended, canceled, or revoked for any reason, including failure to submit a current physical examination, shall be removed from all service to the School District.

204. Failure to Stop For or Yield to an Emergency Vehicle Any driver who while operating under this contract deliberately fails to stop for or yield to an emergency vehicle displaying red flashing lights and with siren activated shall be removed from all service to the District.

208. Failure to Stop For Grade Level Crossings Failure of a driver to properly stop for a grade level crossing shall result in the following penalties:

Failure to stop with a train present
First Offense: Exclusion of the driver from further service to the School District
Notification of the Minnesota Department of Public Safety
Request that the reporting train crew make a report to the Saint Paul Police Department

Total Failure to Stop (Crossing at 5 mph or more):
First Offense: Suspension of the driver from service to the District for one school year.
Second Offense: Exclusion of the driver from further service to the School District.

Rolling Stop - (Wheels never stop moving):
First Offense: Written Warning to driver and bus contractor.
Second Offense: Suspension of the driver from service to the District for one school year.
Third Offense: Exclusion of the driver from further service to the School District.

Failure to Open Entrance Door and Driver’s Window:
First Offense: Written notification of contractor.
Second Offense: Written warning of driver and bus contractor.
Third Offense: Suspension of the driver from service to the District for one school year.
Fourth Offense: Exclusion of the driver from further service to the School District.
